A comprehensive review of Minnesota’s Guardianship Statute
Since 2017 a large group of professionals, including attorneys, guardians, and state and court entities started a comprehensive review of Minnesota’s Guardianship Statute and began drafting changes to modernize the statute. Some specifics in modernizing Minnesota’s guardianship law include changes to how capacity is defined, introducing a definition of supported decision making, and identification of supported decision making as a legal alternative to guardianship. Other highlights are important privacy protections and clarification and increased transparency if guardians limit visitation overall, making the law more protective and more person-centered.
In a unanimous vote of 134 to 0 this bill was passed on Wednesday May 13th. On Saturday May 16th Governor Walz signed this bill in to law!
